1. Agreement to Terms
These Terms of Use govern access to and use of Cardex – Sports Card Scanner, provided by Obzena LLC, incorporated in Wyoming. By downloading, installing, or using the App, you agree to be bound by these Terms.
2. Description of Service
Cardex is a mobile application enabling users to scan and identify sports trading cards via artificial intelligence. The App provides card identification, estimated values, collection management tools, and related features.
AI-Powered Identification: Card images are analyzed by an AI model to identify details such as player name, year, set, and condition. Results are provided for informational purposes only and should not be relied upon for high-value transactions without independent verification.
3. Eligibility
You must be at least 13 years of age to use Cardex. Users under 18 require parental or legal guardian permission. By using the App, you represent and warrant that you meet these eligibility requirements.
4. User Responsibilities
You agree to use Cardex only for lawful purposes. You must not:
- Upload images that are illegal, infringing, or otherwise inappropriate.
- Attempt to reverse engineer, decompile, or tamper with the App.
- Use the App to engage in fraudulent valuation or misrepresentation of cards.
- Abuse, overload, or disrupt servers or infrastructure.
- Resell or redistribute App content or AI outputs without written permission.
5. Image Submission & AI Processing
When you capture or upload a card image, it is transmitted to the AI service for analysis. You represent and warrant that:
- You own or have the right to submit the images provided.
- The images do not contain sensitive personal data of third parties.
Images are processed in real time and are not retained on servers after analysis. By submitting an image, you grant a temporary, limited license to process it solely for identification service purposes.
6. Accuracy Disclaimer
Card identification results, condition assessments, and value estimates are generated by AI and are for informational purposes only. Obzena makes no representations or warranties regarding accuracy, completeness, or reliability of any AI-generated output.
Independent professional appraisal is strongly recommended before buying, selling, or insuring high-value cards based on App results.
7. In-App Purchases & Subscriptions
Cardex may offer premium features through subscriptions or one-time purchases processed via Apple's App Store. All purchases are subject to Apple's terms and conditions. Payment card information is not stored or processed directly.
Subscription fees are non-refundable except as required by applicable law or Apple's refund policy. You may manage or cancel subscriptions through your Apple ID account settings.
8. Intellectual Property
All content, design, trademarks, and software within the App are owned by or licensed to Obzena LLC. You may not reproduce, distribute, or create derivative works without prior written consent.
Sports card images, player names, and related trademarks are the property of their respective owners. Cardex does not claim ownership over any third-party intellectual property displayed as part of card identification results.
9. Limitation of Liability
To the maximum extent permitted by applicable law, Obzena LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including financial losses resulting from reliance on AI-generated card valuations.
Total liability to you for any claims shall not exceed the amount you paid in the twelve (12) months preceding the claim.
10. Indemnification
You agree to indemnify, defend, and hold harmless Obzena LLC and its officers, directors, employees, and agents from any claims, damages, or expenses (including reasonable attorney's fees) arising from your use of the App or violation of these Terms.
11. Termination
Obzena reserves the right to suspend or terminate your access to the App at any time, with or without notice, for violations of these Terms or for any other reason at its sole discretion. Upon termination, your right to use the App ceases immediately.
12. Governing Law
These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict of law provisions. Any disputes shall be resolved exclusively in the state or federal courts located in Wyoming.
13. Changes to These Terms
Obzena may revise these Terms at any time. Notification of significant changes occurs by updating the "Last Updated" date or through in-app notification. Continued use of the App after changes constitutes acceptance of the revised Terms.
